1. Scope
These terms apply to all contracts between Good Point GmbH ("HancVoice", "we") and the users ("you") regarding the use of the services provided at hancvoice.com. We do not accept conflicting or deviating terms unless we have expressly agreed to their validity in writing.
2. Provider & conclusion of contract
The provider is Good Point GmbH, Liechtensteinstrasse 63/10, 1090 Wien, Österreich (for details see the Imprint). The contract is concluded upon registration of an account or upon booking a paid plan. The presentation of the plans constitutes an invitation to submit an offer; the contract becomes effective through our confirmation or activation.
3. Description of services
HancVoice offers AI-assisted speech synthesis (text-to-speech), the creation of individual user voices, voice conversion ("Transformation"), transcription, a moderated voice marketplace and a REST API. The scope of functions and services depends on the chosen plan. We continuously develop the service further; objectively justified changes to the scope of functions remain reserved, insofar as they are reasonable.
4. Account & user obligations
- You are responsible for keeping your access credentials confidential.
- You represent that you hold the necessary rights to all entered texts and uploaded audio data.
- Prohibited in particular are unlawful uses, uses infringing personality rights, misleading uses (deepfake imitation of real persons without consent) or harassing uses. Our Acceptable Use Policy applies.
- AI transparency & voice imitation: AI-generated audio content must be disclosed as artificially generated where legally required (Art. 50 of Regulation (EU) 2024/1689 — the AI Act). Imitating the voice of a real person without their consent is prohibited; complaints from depicted persons are handled under our notice-and-action procedure.
5. Author voices & consent
The creation of your own author voice from a voice sample requires the demonstrable consent of the person concerned (see Consent to voice processing). You are responsible for ensuring that valid consent exists for every voice created. The voice sample serves exclusively to create a synthetic author voice for narrating texts and not to uniquely identify a natural person (no biometric identification within the meaning of Art. 9 GDPR). We are entitled to block content and voices in the event of a justified suspicion of legal violations.
6. Usage rights in audio outputs
Insofar as legally permissible and subject to full payment, you receive a non-exclusive, transferable right of use in the audio outputs you generate, for your own — including commercial — purposes. Third-party rights in underlying texts or voices remain unaffected.
7. Marketplace & payouts
The voice marketplace has not been launched yet — the rules below apply only from its launch; until then there is no publication in the marketplace, no revenue share and no payouts. Once launched: authors can offer their own voices in the marketplace after separate moderation. The Payout Terms apply to revenue sharing and payouts; the author's share is 70 %. Payouts are made in accordance with the deadlines stated therein via the payment service provider.
8. Prices & payment
The prices stated on the pricing page at the time of booking apply. You will find the current prices and packages on the pricing page (/pricing). Payment is processed via our payment service provider (Stripe). All prices are inclusive of statutory value-added tax, where applicable.
9. Term & termination
Subscriptions run for the billing period chosen at booking — monthly or yearly. Unless terminated in time, they automatically renew for the same period and are charged at the start of the new period at the price then in effect (payment is processed via Stripe). We will notify you in good time by e-mail before any automatic renewal and of any price changes.
Termination is possible at any time to the end of the current billing period. You have two equivalent options: (a) while signed in, in your account under Settings via the "Cancel subscription" button; or (b) without signing in, via our public cancellation page hancvoice.com/subscription-cancel (statutory cancellation button under § 312k BGB / equivalent consumer-law requirements). After cancellation there is no further renewal; access remains until the end of the already-paid period. The right to extraordinary termination for good cause remains unaffected.
10. Right of withdrawal for consumers
Consumers have a statutory right of withdrawal of 14 days. Details and the model withdrawal form can be found in the Withdrawal Instructions. For digital content/services, the right of withdrawal expires prematurely (§ 18(1) no. 11 FAGG) if performance has begun with your express consent before the end of the period, you have confirmed your acknowledgement of the loss of the right of withdrawal, and we have provided you with a confirmation of the contract on a durable medium (§ 7(3) FAGG).
11. Availability & warranty
We strive for high availability but do not owe uninterrupted accessibility. Maintenance windows and force majeure may restrict availability. The statutory warranty rights apply.
12. Liability
We are liable without limitation for intent and gross negligence as well as for injury to life, body or health. For property and financial loss caused by slight negligence, our liability is — to the extent permitted by law — limited or excluded. The limits of an effective limitation of liability follow mandatorily from § 6 KSchG (Austrian Consumer Protection Act) and from the prohibition of gross disadvantage under § 879(3) ABGB; a grossly disadvantageous exclusion of liability is invalid. Mandatory liability under the Product Liability Act (Produkthaftungsgesetz, PHG) remains unaffected.
13. Final provisions
Austrian law applies to the exclusion of the UN Convention on Contracts for the International Sale of Goods (CISG); mandatory consumer protection provisions of the consumer's country of residence remain unaffected. Should any provision be invalid, the validity of the remaining provisions remains unaffected. Information on online dispute resolution can be found at /legal/odr.
